Deputies Arrest Driver with 0.36 BAC

Clay County Deputies responded to a call about driver slumped over the wheel of a car at about 8:30 pm on Tuesday, August 16. The vehicle was reported to be stopped on the ramp to southbound I-35 from 291 Highway.

When the deputies arrived, the driver was out of the vehicle and lying on the grass. The driver told deputies that he had just had two margaritas with his dinner, but he failed a breath test with a 0.36 blood alcohol content. Deputies also observed multiple open alcohol containers in the vehicle.

“That’s fatal for most people,” noted the Sheriff’s office. Missouri law states it is illegal to drive with a BAC of .08 or higher. Deputies immediately called for an ambulance to transport the driver to the hospital.

The driver, who has previous DWI convictions, faces a DWI charge and was left in the care of hospital staff.
